2) Definitions
“Customer” / “you” means the entity that subscribes to or uses the Service. “Business User” means an administrator, agent, or other authorized user under a Customer account. “End User” means a natural person who interacts with the Customer’s embedded chatbot (e.g., the Customer’s website visitors/users). “Customer Content” means any content you upload, submit, or make available through the Service (e.g., help center articles, documentation, FAQs, chat messages, identity attributes provided via snippet). “DPA” means our Data Processing Addendum, which governs how we process Customer Personal Data on Customer’s behalf.
3) The Service
AnsrFast enables customer-facing teams to configure and embed an AI support chatbot, manage written conversations, and escalate to human support agents. The Service may evolve over time.
4) Eligibility and Accounts
You represent that you have authority to bind your organization. You are responsible for maintaining the confidentiality of credentials and for all activity under your account.
5) Acceptable Use
You must not: - Use the Service for unlawful, harmful, or fraudulent activities. - Attempt to probe, scan, or test the vulnerability of the Service. - Interfere with or disrupt the Service or its infrastructure. - Upload malware or malicious code. - Infringe intellectual property or privacy rights of others. - Intentionally submit special categories of data (e.g., health data) unless expressly agreed in writing. We may suspend or terminate access if we reasonably believe you violate these Terms or pose a security risk.
6) Customer Responsibilities for End Users (Embedded Chat)
6.1 Controller role. As between the parties, Customer determines the purposes and means of processing End User data collected via the Embedded Chat. Customer is responsible for providing required notices to End Users and ensuring a lawful basis for collecting and sharing End User data for support purposes. 6.2 Snippet identity attributes. If Customer sends end-user identity attributes to AnsrFast (e.g., first name, last name, email, profile picture or URL), Customer represents it has the right and lawful basis to do so and has informed End Users as required. 6.3 End User requests. Customer is responsible for responding to End User privacy requests. AnsrFast will provide reasonable assistance as described in the DPA.
7) Customer Content and Data
7.1 Ownership. Customer retains all rights to Customer Content. We do not claim ownership over Customer Content. 7.2 License to operate. Customer grants AnsrFast a limited, worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide, maintain, secure, and improve the Service and to perform our obligations under these Terms. 7.3 No training by default. We do not use Customer Content or End User chat content to train our own general-purpose machine learning models unless we obtain Customer’s explicit permission. We may use aggregated and anonymized metrics to improve reliability and performance.
8) AI Features Disclaimer
AI-generated responses may be inaccurate, incomplete, or inappropriate. Customer is responsible for supervising the Service and validating outputs before relying on them, especially for high-stakes topics (legal, medical, financial, safety).
9) Security
We implement reasonable administrative, technical, and organizational measures to protect the Service. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.
10) Privacy and Data Processing
10.1 Privacy Policy. Our Privacy Policy describes how we process personal data as a controller for website visitors and business users. 10.2 DPA. If we process personal data on Customer’s behalf (e.g., End User chat data), the DPA applies and is incorporated into these Terms by reference. In case of conflict regarding Customer Personal Data, the DPA prevails.
11) Fees, Billing and Taxes
If Customer purchases a paid plan, Customer agrees to pay fees displayed at checkout or in an order form. Payments may be processed by third-party processors (e.g., Stripe). Fees are non-refundable except where required by law or expressly stated otherwise. Customer is responsible for applicable taxes.
12) Third-Party Services
The Service may integrate with third-party services (hosting, email, realtime infrastructure, etc.). We are not responsible for third-party services beyond our obligations under these Terms and the DPA.
13) Term and Termination
These Terms begin when Customer first uses the Service and continue until terminated. Customer may stop using the Service at any time. We may suspend or terminate access if necessary for security, legal compliance, or material breach. Upon termination, deletion/return of Customer Personal Data is handled as described in the DPA (and Account Data is handled under the Privacy Policy as applicable).
14) Warranty Disclaimer
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
15) Limitation of Liability
To the maximum extent permitted by law: - We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. - Our total liability arising out of or relating to the Service will not exceed the amounts paid by Customer to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim (or EUR 100 if Customer has not paid anything). Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.
16) Indemnity
Customer agrees to indemnify and hold us harmless from claims arising out of: (a) Customer Content; (b) Customer’s use of the Service in violation of these Terms; (c) Customer’s violation of applicable law or third-party rights, including required End User notices and lawful bases.
17) Changes
We may update these Terms from time to time. If changes are material, we will post updated Terms and revise the “Last updated” date. Continued use after changes become effective constitutes acceptance.
18) Governing Law and Jurisdiction
These Terms are governed by French law. The courts of Paris have jurisdiction, unless mandatory law provides otherwise.
